However, there are several things to consider from a legal standpoint.
Generally speaking, you can fly with CBD oil as long as it’s hemp-derived, meaning it contains less than 0.3% tetrahydrocannabinol (THC). In response to confusion about whether or not you can travel with hemp-derived and cannabis-derived products on Twitter, TSA responded by saying “products that contain hemp-derived CBD oil or are FDA-approved are generally legal and can fly.”
The reason for this is the 2018 Farm Bill, which legalized hemp-derived products in the United States. Keep in mind that hemp plants are simply cannabis plants specifically grown to contain less than 0.3% THC.
On TSA’s official website, they state that “Marijuana and certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA.” (See the Agriculture Improvement Act of 2018, Pub. While the CBD bottle itself should specify the percentage of THC, the only way to know with certainty is by looking at the third-party lab test results.
